Folk musician Doc Watson dies at age 89

The manager of Grammy-winning folk musician Doc Watson says the artist has died. He was 89.

Mitchell Greenhill said in a news release that Watson died Tuesday at Wake Forest Baptist Hospital Medical Center in Winston-Salem, N.C. A hospital spokeswoman also confirmed Watson's death.

Watson was a master flatpicker, playing his acoustic guitar at lightning speeds that could intimidate other musicians. The blind musician also sang and played other instruments, including the harmonica.

His many awards include the National Medal of the Arts in 1997 and the lifetime achievement award from the Grammys in 2004. His albums earned seven other Grammys.

Watson was also known for Merlefest, an annual gathering of musicians in Wilkesboro named after his son, who died in a tractor accident in 1985.

At the same symposium, Kaido Yuichi, the secretary general of the Japan Federation of Bar Associations, called for a change in judicial rules in relation to the two-year-old lay judge system. At present, a death sentence can be delivered if the majority of the 9 judges?six non-professionals and three professionals?vote in favor of it and one of the majority is a professional judge. The JFBA, which has called on the government to launch a public debate on abolishing the death penalty, says that death sentences should only be validated if the decision is unanimous.

When the lay judge system itself was being debated, one prominent lawyer who opposed it, Takayama Shunkichi, claimed that it was being pushed by the government to "streamline courtroom procedures" so that prosecutors could gain faster convictions, since there were provisions that take into consideration the limited time the average person could spend to sit for a trial. These provisions require judges, prosecutors and defense lawyers to participate in pretrial meetings to determine what will be discussed in court and what evidence is permitted. Takayama said such conditions automatically favor the prosecution, because once the evidence has been determined in the pretrial phase nothing can be changed, added or subtracted. A defendant cannot recant in court a confession he or she may have made under duress. As a practicing defense attorney, Takayama has said that of the twenty-odd cases that he has won over the years, ?none involved trials of less than three years.?

All of these issues were addressed either directly or indirectly during the recent trial of Kijima Kanae, who was convicted of killing three men and sentenced to death. The trial lasted 100 days, making it the longest one since the lay judge system started. More significantly, the prosecution presented only circumstantial evidence, thus forcing the lay judges to not only decide if someone is guilty but also send that person to death row based mostly on conjecture. In contrast, the even more infamous 1998 ?Wakayama curry poisoning,? which also involved a defendant who was convicted and sentenced to death based solely on circumstantial evidence, took four years. There are other parallels. Like Kijima, Hayashi Mayumi remained almost completely silent during interrogations. More significantly, both cases were hallmarked by the media's blanket coverage of the crimes, much of which actually preceded the suspects? arrests. Some reporters who had already been following the Kijima case implied that she was responsible for the deaths of a number of men she had allegedly led on with promises of marriage. At least three of these men died under conditions that looked suspicious: two in identical circumstances involving the use of burning charcoal, and a third in a house fire. The former were initially ruled suicides, the latter an accident. Kijima's initial arrest in 2009 was for fraud, but after the media connected her to the deaths of several men she supposedly had affairs with, she was eventually served arrest warrants for the murders of three. Kijima reportedly took cash from them, and prosecutors cited money as the motive in all three alleged murders, an aspect of the case that the media had covered in lurid fashion as a "black widow" story intensified by a blatantly sexist angle which questioned how such an unattractive woman could be so successful as a gold digger. By the time the trial started last January everyone in Japan with access to a TV or broadband connection knew the tale and most were likely convinced of her guilt.

In April, NHK ran a special hour-long program about the trial. According to the law, lay judges cannot discuss afterward what they talked about in closed chambers, even with family, so in order to get some idea of what might have taken place the producers found six people who had served as lay judges in the past and provided them with court records and materials. They used these materials and their experience to recreate what the lay judges at the Kijima trial might have gone through before reaching their guilty verdict and death sentence.

All six agreed that the real lay judges in the case had their work cut out for them since the prosecution's entire argument rested on three pieces of circumstantial evidence and a motive that made sense but had to be inferred since there was no confession. The mock lay judges went through each item with tortured thoroughness. The two men who the defense claimed committed suicide had died from asphyxiation caused by charcoal stoves. Prosecutors say that Kijima drugged them and lit the stoves herself. They claimed that the fact that one of the victims did not have charcoal on his hands when he was found dead proved that he didn't kill himself because he obviously hadn't handled any charcoal. But the mock judges surmised that if he had killed himself he could have wiped his hands prior to lighting the charcoal. Prosecutors also submitted as evidence surveillance camera footage showing that Kijima visited the home of the third victim hours before his house burned down. The man was killed in the fire and the prosecution's claim was that she started it. The mock judges didn't see how the footage decisively showed a connection between Kijima's visit and the fire.

They eventually reached the conclusion that the prosecution's case was based on a very sloppy police investigation, but that didn't necessarily mean they didn't buy it, because the motive put forth by the prosecution had become too easy to believe: Kijima had extracted money out of these men on the false pretense that she might marry them and once they found out she wouldn't they would surely demand the money back, so she killed them. NHK did not mention the media's role in planting this notion in the public's mind over a two-year period, but the prosecution's closing argument exploited the notion with a metaphor: When you wake up in the morning and see snow on the ground where there was none the day before, you know for a fact that it snowed during the night. In other words, the judges should know just by looking at all the circumstances in the case what happened. They don't really need anyone to prove it.

In the end, the mock judges assumed that the lay judges who actually tried the case had reached their conclusion because something had nudged them "out of the gray area" presented by the evidence and into a "black area" of a conviction. What provided that nudge they couldn't guess, though film director Suo Masayuki, who acted as a commentator on the program, implied that the professional judges "who have everyday experience in this situation" may have been the decisive factor. In essence, the pre-trial publicity had placed the burden of proof on the defense attorney, who had to show that his client didn't murder the three men. As far as the death sentence went, the mother of one of the victims was allowed to testify during the trial, and she asked for the harshest possible punishment.

The conclusion reached by the show?s commentators was that there are still problems with the lay judge system but that its value as a platform for judicial participation has been proven, if only by the dedication that lay judges have demonstrated. Nevertheless, NHK had illustrated the confusion that lay judges feel when confronted with the responsibility of interpreting the law and deciding a person's fate. They are told definitively that they must only consider the facts presented to them, but they are also encouraged to go with their gut, to reach a verdict based on which story they think is the most plausible. Was the prosecution's narrative more believable than the defense's? One of the mock judges, remembering the real trial she judged last year, a trial that ended with the accused sentenced to death, broke down in tears because she didn't know anything for sure. Jurors are told they shouldn't convict if there is a shadow of a doubt, but for the mock judges the entire process was darkened by doubt.

At the end of the program NHK interviewed one of the real lay judges in the Kijima case. He wasn't allowed to discuss the decision in detail but admitted it had been "difficult to make a clear judgment." And in the end there was "no option but to convict. We did what we were supposed to do."

UC Davis mathematicians have helped biologists figure out why platelets, the cells that form blood clots, are the size and shape that they are. Because platelets are important both for healing wounds and in strokes and other conditions, a better understanding of how they form and behave could have wide implications.

"Platelet size has to be very specific for blood clotting," said Alex Mogilner, professor of mathematics, and neurobiology, physiology and behavior at UC Davis and a co-author of the paper, published this week in the journal Nature Communications. "It's a longstanding puzzle in platelet formation, and this is the first quantitative solution."

Mogilner and UC Davis postdoctoral scholars Jie Zhu and Kun-Chun Lee developed a mathematical model of the forces inside the cells that turn into platelets, accurately predicting their final size and shape.

They were collaborating with a team led by Joseph Italiano and Jonathon Thon at Harvard Medical School and Brigham and Women's Hospital, Boston.

Platelets are made by bone marrow cells called megakaryocytes. They bud off first as large, circular pre-platelets, form into a dumbbell-shaped pro-platelet, then finally divide into a standard-sized, disc-shaped platelet. A typical person has about a trillion platelets in circulation at a time, and makes about 100 billion new platelets a day, each living for 8 to 10 days.

Inside the pre- and pro-platelets is a ring of protein microtubules, which exerts pressure to straighten and broaden the nascent cells. But overlying the ring is a rigid cortex of proteins that prevents the platelets from expanding.

By tweaking the number of microtubules in the bundles, Mogilner, Zhu and Lee found that they could correctly predict how pro-platelets would flip into a dumbbell shape, as well as the size and shape of mature platelets.

Updated at 8:00 a.m. ET: Most of the 108 victims of the Houla killings in Syria were executed, the United Nations said Tuesday ? an announcement that triggered a coordinated worldwide expulsion of Syrian diplomats.

The U.N. High Commissioner for Human Rights says its monitors found that fewer than 20 died from artillery fire. It was first thought the majority of the deaths were caused by artillery fire.


Images of bloodied, young bodies laid out in a shallow grave after Friday's onslaught triggered shock around the world and underlined the failure of a six-week-old U.N. cease-fire plan to stop the violence.

Syrian authorities blamed "terrorists" for the massacre, among the worst carnage in the 14-month-old uprising against Assad, which has cost about 10,000 lives.

In an effort coordinated by Britain, several nations - including Canada, Australia, France and Germany - responded to the U.N. findings by expelling diplomats, as ITV News reported. Syria's charge d'affaires, Ghassan Dalla, the country's topranking diplomat in London, was among those ordered to return to Damascus.

The U.N. statement came as UN-Arab League envoy Kofi Annan was meeting President Bashar Assad in Damascus on Tuesday.

Rupert Colville, spokesman for the UNHCR, told the journalists in Geneva that initial investigations suggest fewer than 20 of the victims in the village of Taldou, near Houla, were killed by artillery or tank fire.

"Most of the rest of the victims in Taldou," he told the BBC, "were summarily executed in two separate incidents."

Most of the victims were shot at close range. "At this point it looks like entire families were shot in their houses," Colville was quoted as saying by The Telegraph.

He said the conclusions of the U.N. monitors are corroborated by other sources, and that witnesses blamed pro-government militias for the attacks.

The U.N. Security Council on Sunday unanimously condemned the Syrian government for heavy-weapons attacks on Houla.

"The Security Council condemned in the strongest possible terms the killings, confirmed by United Nations observers, of dozens of men, women and children and the wounding of hundreds more in the village of (Houla), near Homs, in attacks that involved a series of government artillery and tank shellings on a residential neighborhood," a non-binding statement said.

U.S. Secretary of State Hillary Clinton demanded that those who carried out the killings be held to account.

"The United States will work with the international community to intensify our pressure on Assad and his cronies, whose rule by murder and fear must come to an end," she said.

But wait, it gets worse if that is possible. Not only are young workers at an all-time low, those individuals working who are 65 years and older are at an all-time high. They simply cannot afford to retire. As reported at the NY Times, But that may have worsened the employment prospects for younger workers. Ya think?

Labor Department figures indicate that the percentage of workers over the traditional retirement age of 65 is at a record high. But, the figures show, job totals fell sharply for men under 55 during the recession and have only started to recover, while the proportion of women ages 25 to 54 with jobs also slid and is close to the lowest level of the last two decades.

?The fact of the matter is that this aging-but-not-yet-aged segment of the baby boomer class can?t afford to retire,? said David A. Rosenberg, the chief economist of Gluskin Sheff, a Canadian firm, noting that overall household net worth was 15 percent lower than at the prerecession peak. ?Dreams of the 5,000-square-foot McMansion being a viable retirement asset.

So why is any one voting for Barack Obama again? Any one who actually thinks that Obama has any coherent economic jobs growth plan is delusional. Every demographic has suffered under Obama and the more a demographic struggles with high unemployment like blacks, the more they back Obama. That?s a brilliant position.

BAGHDAD (AP) ? Iraq's president on Saturday urged the nation's bickering factions to resolve the bitter political dispute that has gripped the government for nearly six months, warning that the crisis threatens to split the country.

President Jalal Talabani's statement, posted on his website, is the latest plea for an end to the crisis that has engulfed Iraq since Shiite Prime Minister Nouri al-Maliki's government issued an arrest warrant for the country's Sunni vice president in December ? just as the last U.S. troops left the country.

Shiite, Sunni and Kurdish politicians have been holding meetings for weeks to discuss how to resolve the deadlock, including whether to try to push al-Maliki to step down before the end of his four-year term in 2014. Al-Maliki's critics accuse him of consolidating power and sidelining both Sunnis and Kurds, touching off a political impasse that has brought government work to a near standstill.

Already, the president of Iraq's northern self-rule Kurdish region has said he will hold a popular referendum on whether to secede if the deadlock is not solved by local elections set for September.

"I am firmly convinced of the seriousness of the current circumstances which require that we speed up efforts to sit at the table of constructive and fraternal dialogue," said Talabani, a Kurd, whose post is largely ceremonial.

Otherwise, he said, the crisis "could lead to growing tensions and exacerbate the risks and problems."

Talabani in the past has played the role of a mediator in Iraq's frequent political disputes.

The political threat to al-Maliki has shifted over several months, and it's not clear whether parliament will force the vote to oust him. The prime minister on Saturday issued his own plea for talks, saying "dialogue and clarity is what can bring good."

"The dialogue should be objective and on the basis of acceptance of others," al-Maliki said in a statement issued on his website. "Because (opposing) lineups do not bring any good to Iraq."

After his political alliance fell short of winning the most seats in parliament to a secular but Sunni-dominated coalition in 2010 elections, al-Maliki kept his job only by cobbling together enough support from Kurdish leaders and hardline Shiite cleric Muqtada al-Sadr, his longtime rival.

But over the last two years, al-Sadr has shifted to the ranks of the prime minister's Kurdish and Sunni critics, who complain that the government is corrupt and is not doing enough to provide jobs and public services like electricity for Iraqis.

Experts fear the political impasse will strain already simmering tensions and ignite more violence.

On Saturday, a roadside bomb killed three Iraqi soldiers in Badoush, a town in northern Iraq, two security officials said. Badoush is about 20 kilometers (12 miles) northwest of Mosul, Iraq's third-largest city and a former al-Qaida stronghold. Both officials spoke on condition of anonymity because they were not authorized to release the information.

Memorial Day in Their Words: Reflections from Veterans, Servicemembers and Their Families

Andrew Riggio's father, a WWII combat photographer, stormed Normandy Beach with a pistol in one hand -- and a camera in the other.

"Only an American would have the guts to run up that beach shooting pictures instead of bullets," he writes. "Our soldiers displayed so much courage and should be honored for it."

Alicia Cattoni recalls sharing bologna sandwiches with her grandfather, Ed Marshall, as he regaled her with his heroic Korean War stories, while her grandmother scolded him for doing so.

"I'm very proud of our veterans and servicemembers. If it weren't for people like my grandfather, I wouldn't be here today," she writes. Marshall served as an Army Machine-Gun Sergeant in F Company and the Section Leader in H Company during the 1950s in Korea.

Emilia Zs Rak's husband never speaks of war's horrors while he's awake. But when he's sleeping, she's acutely aware of the pain he encountered.

"Every time my husband revisits Vietnam in his sleep, I am starkly reminded of how a piece of his humanity was taken. But he gave it willingly so that future generations could sleep through the night without the horror and inhumanity he experienced," she writes. "On Memorial Day and every day I say, 'Thank you for your service! Thank you for my peace at night.' "

Nearly everyone in America with a car loan is making the payment on time, the Detroit Free Press is reporting.

A scant .36 percent of people with a car loan are 60 or more days behind on making their payment, according to a TransUnion report looking at the January through March quarter of auto loan payments. That means more than 99-percent of customers borrowing cash for cars are on time.

The tiny percentage, which represents a drop of about 27 percent year-over-year is the lowest since TransUnion started tracking it in 1999.

The fall in loan delinquency, however, may not be great news for banks overall. TransUnion attributes some of the on-time payments to recession weary consumers placing a priority on their car payment while foregoing payments on credit cards and underwater homes.

Sears Holdings returns to a profit in 1st quarter

(AP) ? Sears Holdings Corp. returned to a first-quarter profit, benefiting from a gain on the sale of some stores.

The Hoffman Estates, Ill., company, which runs Sears, Kmart and Lands' End, also said Thursday that it plans to spin off a minority stake in Sears Canada Inc. Its stock jumped in premarket trading.

Sears earned $189 million, or $1.78 per share, for the period ended April 28. It lost $170 million, or $1.58 per share, a year ago.

The current quarter included a $233 million gain on the sale of some U.S. and Canadian stores and leasehold interest.

Excluding store closing costs and other items, Sears lost 31 cents per share from continuing operations. Analysts expected a loss of 67 cents per share.

Revenue slipped 3 percent to $9.27 billion, partly hurt by unfavorable foreign currency exchange rates and having fewer stores open during the period. Still, the performance managed to beat Wall Street's forecast of $9.26 billion.

Shares of Sears gained $4.68, or 9.2 percent, to $55.20 before the market open.

Revenue from Sears stores in the U.S. open at least a year fell 1.6 percent, while the figure dropped 1.6 percent for Kmart locations. Both Sears and Kmart stores experienced soft sales of consumer electronics but stronger sales of clothing and footwear. For Sears Canada, the metric slid 6.3 percent on declines in electronics, home decor, hardware and clothing.

This figure is a key indicator of a retailer's health because it excludes results from stores recently opened or closed.

Sears Chief Financial Officer Rob Schriesheim said in a statement that the company anticipates that it will generate $1.6 billion to $1.7 billion in capital this year through a number of actions, including previously announced cost reductions and moves taken to lower cash invested in inventory, the sale of certain stores in the U.S. and Canada and the spinoff of its smaller Hometown and Outlet stores. Sears' cash balance climbed to $784 million from $754 million over the three-month period ending April 28. It has also reduced inventory levels and trimmed its total debt to $3.2 billion at quarter's end, down from $3.5 billion.

Earlier this month at its annual meeting, Sears executives emphasized the company's financial strength, increased liquidity and prospects to boost operational results. During the meeting, Chairman Edward Lampert said that real estate sales were important to restore profitability and to get shareholders' confidence back.

Sears will keep an approximately 51 percent stake in Sears Canada, down from 95 percent. The proposed spinoff is expected to close this year, with Sears Canada continuing to list on the Toronto Stock Exchange after the deal's closing.

Sears currently has more than 3,900 stores in the U.S. and Canada.
